The Housing Authority of the City of San Buenaventura EQUAL OPPORTUNITY EMPLOYER General Counsel Salary Range Bi-weekly $3,178.38 - $3,969.36 DEFINITION Serves as General Counsel to the Agency, including but not limited to executive staff, senior management and the Agency's Board of Commissioners. Under the direction of the Chief Executive Officer, will lead, provide assistance and advice, and oversee and participate in a broad variety of legal activities. Represent the Authority in matters related to evictions, unlawful detainer litigations, tenancy, planning and land use, property management, contracts, real estate projects, and various other related legal work as required. May attend various board, commissions and committee meetings. The position is responsible for regularly exercising independent judgment, discretion and initiative within a general policy framework established by the CEO and Board of Commissioners. This position currently has part time administrative support. ESSENTIAL FUNCTION STATEMENTS: The below statements are intended to describe the general nature and scope of work being performed by this position. This is not a complete listing of all responsibilities, duties and or skills required. Management reserves the rights to add, modify, change, or rescind the work assignments of different positons. Essential duties may include but are not limited to the following: Functions as an integral partner within the CEO's senior leadership team.Communicates with Deputy Director-Property Operations concerning tenancy issues and litigation matters, and provides legal opinion on eviction-related issues as required.Prepares drafts and develops a variety of complex legal documents including contracts, agreements, ordinances, appeals and resolutions.Plans, directs and participates in litigation, and prepares court litigation documents including pleadings, motions, briefs and responses. Communicates with Agency insurance providers as needed, and keeps them updated on case information.Represents the Authority in proceedings before Federal and State courts, mediation and administrative hearings, and/or assists employees in preparation for court appearances including hearings and trials, and arranges and attends depositions.Judges the merits of court cases, regulatory inquiries, and other legal actions filed against or on behalf of the Agency. Works with the appropriate executives to define strategic positions and/or defenses, and recommends settlements of disputes where warranted.Participates in the development of Agency policies, procedures, and related business documents. Advises the Board of Commissioners, executive staff and senior management on legal matters related to governance and the policies, programs, and projects of the Agency.Receives, reviews, and processes various reports and records, including invoices for legal fees, contacts, legal pleadings, resolutions, ordinances, correspondences, and court cases, new or proposed legislation.Supervises case load from receipt of case to resolution, including notices to vacate, complaints, motions, responsive documents and appearance at trials and/or other hearings. Oversees the selection, retention, management and evaluation of outside counsel in conformity with applicable state and federal procurement requirements.Establishes, manages, and ensures compliance with the budget for outside legal services.Reviews and approves staff reports and proposed resolutions to the Board of Commissioners.Assumes responsibility for general corporate governance, including but not limited to maintaining, updating and ensuring compliance with corporate formation documents and other related filings for the Agency and its affiliated agencies, and providing counsel at Board of Commissioner meetings in conformance with the Brown Act and other applicable regulations.Manages legal work performed in connection with the Authority's public agency administrative functions. (e.g., public records requests, administrative hearings, Fair Housing investigations, HUD inquiries, contracting and procurement, etc.)Drafts and reviews rules, regulations, guidelines, legal opinions and legislation regarding programs administered by the Agency.Must treat people with respect and work with integrity and professional ethics, upholding the agency's values and mission. Represents the agency in a positive, professional and ethical manner at all times. This specifically includes abiding by all of the ethical rules outlined in the Employee Handbook. QUALIFICATIONS: Knowledge of: Legal principles and procedures, including civil and administrative laws and procedures, involving public housing, unlawful detainer, tenancy, planning and land use, property management, contracts, real estate projects, and other litigation matters. Methods of legal research, legal writing, legal procedures and processes, including computer research. Federal, State, and local laws, states, and ordinances with emphasis on civil, and contract law. Federal, State, and local trial and appeal procedures and methods of case preparation and presentation. Legal principles, issues, and practices related to municipal government functions, including specific government operations and relevant legal issues. Court procedures and rules of evidence. Techniques for effectively representing the agency in contracts with governmental agencies, community groups, and various business, professional, regulatory, and legislative organizations. Local social services agencies and appropriate contacts. Principles of business letter writing and basic report presentations. Proper grammar, spelling, punctuation, and composition of client and agency letters. Modern office procedures, business mathematics application, and statistical recordkeeping methods. Operation of standard office equipment. Basic organization, rules, and regulations, including housing program principals, policies and procedures. Pertinent State, Federal, and local housing laws and regulations. Browns Act and Health and Safety Code. Ability to: Conduct research on legal problems and provide sound legal advice to the Board of Commissioners, committees, and departmental staff. Present legal information and advice clearly and persuasively in public sessions. Determine alterative legal and administrative approaches to solving problems. Analyze and prepare a wide variety of legal documents. Prepare and present cases, pleading, and discovers in court. Prepare accurate and effective reports, policies, procedures and other written materials. Organize and prioritize a variety of projects and multiple tasks in an effective and timely manner; organize work, set priorities, and meet critical time deadlines. Use tact, initiative, prudence, and independent judgment within general policy and legal guidelines in politically sensitive situations. Deal diplomatically and sensitively with clients, other agency representatives, and the general public. Maintain the utmost confidentiality of all information. Understand and implement oral and written instructions, and make sound decisions. Establish and maintain effective working relationships with those contacted in the course of work. Communicate clearly and concisely, both orally and in writing. Operate a personal computer using various Windows-based applications and related programs, including standard, as well as proprietary software. EDUCATIONAL/CERTIFICATION REQUIREMENTS Any combination of experience and education that would be likely to provide the required knowledge and abilities could be qualifying, as determined by the Authority. A typical way to obtain the knowledge and abilities would be: High School Diploma and;Juris Doctor degree from an accredited American Bar Association school of law;License to practice law in the State of California and federal court and 2 - 4 years as an attorney practicing law with relevant experience of a public agency.Must obtain a Real Estate license within 1 year. PHYSICAL DEMANDS ON THE POSITION: Reasonable accommodations may be made to enable individuals with disabilities to perform the essential functions. Essential and marginal functions (may) require maintaining physical condition necessary for sitting and standing for prolonged periods of time in indoor office environment. Must have vision to read printed material and a computer screen; and hearing and speech to communicate in person, before groups, and over the telephone. Must stoop, kneel, reach, stretch, bend, pull drawers open and closed to retrieve and file information. Employee must possess the ability to lift, carry, push, and pull materials and objects up to 25 - 50 lbs. with the use of proper equipment. Have excellent hand strength and the manual dexterity to operate keyboard equipment. Special Requirements: Must have access to an automobile or other means of transportation, when and if required to travel on Housing Authority business.Must possess current automobile insurance in accordance with California law and, a valid California driver's license, including a driving record acceptable to the Housing Authority Insurance Company.Position may require evening, weekend work as needed.Must be insurable by the Housing Authority's insurance carriers.Provide proof of US citizenship or, if an alien, either lawful admission for permanent residence or authorization for appropriate work by the Immigration and Naturalization Service.
